When to Seek Professional Help

- Are experiencing thoughts of self-harm or suicide

1. Acceptance of Terms
Welcome to PeacePort. By downloading, installing, or using the PeacePort mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
1.1 Agreement to Terms
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and PeacePort ("we," "us," or "our"). By using the App, you represent that:
- You are at least 18 years of age
- You have the legal capacity to enter into this agreement
- You will comply with all applicable laws and regulations
- All information you provide is accurate and truthful
2. Subscription Terms
PeacePort offers premium features through a subscription model. Please read these terms carefully to understand your billing and cancellation rights.
2.1 Paid Subscription
- Billing: After your free trial ends, you will be automatically charged the subscription fee
- Payment Method: Charges are processed through your Apple App Store or Google Play Store account
- Billing Cycle: Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan)
- Currency: Prices are shown in your local currency as determined by the App Store
2.2 Auto-Renewal
- Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel
- Renewal Charge: You will be charged within 24 hours before the end of the current period
- Renewal Rate: Renewals are charged at the current subscription rate
- Continuous Access: Auto-renewal ensures uninterrupted access to premium features
2.3 Cancellation
You can cancel your subscription at any time with no penalty. Here's how:
For iOS (Apple) Users:
- Open the Settings app on your iPhone or iPad
- Tap your name at the top
- Tap "Subscriptions"
- Select PeacePort
- Tap "Cancel Subscription"
For Android (Google Play) Users:
- Open the Google Play Store app
- Tap the menu icon (three lines) and select "Subscriptions"
- Select PeacePort
- Tap "Cancel Subscription"
2.4 Refund Policy
- Platform Policies: Refunds are subject to Apple App Store and Google Play Store refund policies
- Free Trial: No refunds are necessary if you cancel during the free trial period
- Requesting Refunds:
- Apple: Request refunds through reportaproblem.apple.com
- Google: Request refunds through Google Play Subscriptions
- Our Policy: We do not process refunds directly. All refund requests must go through Apple or Google
2.5 Price Changes
- Notification: We will notify you at least 30 days in advance of any price changes
- Notification Method: Via email and/or in-app notification
- Your Options: You can accept the new price or cancel your subscription before the change takes effect
3. User Responsibilities
3.1 Account Security
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You are responsible for all activities that occur under your account
- You must provide accurate and complete information when creating an account
3.2 Age Requirement
- You must be at least 18 years old to use PeacePort
- By using the app, you represent that you meet this age requirement
- We reserve the right to terminate accounts of users under 18
3.3 Appropriate Use
- Use the app for personal, non-commercial purposes only
- Follow all applicable laws and regulations
- Respect the intellectual property rights of PeacePort and others
- Do not attempt to harm, disrupt, or interfere with the app's operation
4. Prohibited Uses
You agree NOT to:
- Use the app for any illegal purpose or in violation of any laws
- Attempt to reverse engineer, decompile, or disassemble the app
- Copy, modify, distribute, or create derivative works from the app
- Remove or alter any copyright, trademark, or proprietary notices
- Use automated systems (bots, scrapers) to access the app
- Attempt to gain unauthorized access to our systems or networks
- Interfere with or disrupt the app's servers or networks
- Upload viruses, malware, or other malicious code
- Impersonate any person or entity
- Harass, abuse, or harm other users
- Share your account credentials with others
- Use the app to provide services to third parties
5. Intellectual Property
5.1 Ownership
All content, features, and functionality of PeacePort, including but not limited to:
- Text, graphics, logos, images, and audio content
- Software code and architecture
- Meditation scripts and audio recordings
- Design, layout, and user interface
- Trademarks, service marks, and trade names
are owned by PeacePort and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the app for personal, non-commercial purposes
- Download and cache audio content for offline use within the app
This license does NOT include the right to:
- Reproduce, distribute, or publicly display any content
- Create derivative works or modifications
- Use content for commercial purposes
- Extract or download content outside the app
6. Limitation of Liability
6.1 Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the app will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or completeness of content
- Warranties that defects will be corrected
6.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEACEPORT SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Personal injury or property damage
- Damages arising from your use or inability to use the app
- Damages arising from reliance on any content in the app
- Damages arising from unauthorized access to your data
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.
6.3 Medical Liability
WE ARE NOT LIABLE FOR ANY HEALTH-RELATED OUTCOMES, INCLUDING BUT NOT LIMITED TO:
- Worsening of anxiety or mental health conditions
- Failure to seek appropriate medical care
- Reliance on app content instead of professional advice
- Any medical emergencies or health crises
7. Termination
7.1 Termination by You
- You may stop using the app at any time
- You may cancel your subscription as described in Section 2.4
- You may request account deletion by contacting us at Info@vernaldigital.com
7.2 Termination by Us
We reserve the right to suspend or terminate your access to the app:
- If you violate these Terms
- If you engage in fraudulent or illegal activity
- If your account has been inactive for 3 years
- If required by law or legal process
- At our sole discretion, with or without notice
7.3 Effect of Termination
Upon termination:
- Your right to use the app immediately ceases
- Your subscription will be cancelled (no refund for remaining period)
- We may delete your account data after 30 days
- Sections of these Terms that should survive termination will remain in effect
8. Changes to Terms
We may modify these Terms at any time. When we make changes:
- We will update the "Last Updated" date at the top of this page
- For material changes, we will notify you via email or in-app notification
- We will provide at least 30 days' notice before changes take effect
- Your continued use after changes become effective constitutes acceptance
If you do not agree to the modified Terms, you must stop using the app and cancel your subscription.
9. Governing Law & Dispute Resolution
9.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
9.2 Dispute Resolution
In the event of any dispute arising from these Terms or your use of the app:
- Informal Resolution: We encourage you to contact us first at Info@vernaldigital.com to resolve the issue informally
- Mediation: If informal resolution fails, we agree to attempt mediation before pursuing litigation
- Arbitration: Any disputes that cannot be resolved through mediation shall be resolved through binding arbitration
